Terms of Service

These Terms of Service (the "Terms") govern your use of Requestify (the "Service"), operated by Elm Studios AI Inc. ("we", "our", "us"). By installing, connecting, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The service

Requestify is an AI-powered call and email intake tool for Jobber users. It receives incoming phone calls from your connected Quo (OpenPhone) account and forwarded emails routed to a Requestify address, classifies and extracts structured fields from each conversation, validates addresses, and creates the matching Jobber service request on your behalf.

Requestify is an independent integration and is not an official product of Jobber (Octopus Research Inc.). Use of the Service does not modify your existing agreement with Jobber.

2. Account and access

You must have an active Jobber account to use Requestify. Authentication is delegated to Jobber via OAuth and to Google or magic-code email for individual team-member sign-in. You are responsible for the security of your Jobber credentials and for all activity under your account.

3. Acceptable use

You agree not to:

• Use the Service in violation of any law or third-party right.
• Access the Service by any means other than the interface we provide, including scraping, automated clients, or unofficial APIs.
• Reverse-engineer, decompile, or attempt to extract source code, except as permitted by law.
• Resell, sublicense, or redistribute the Service.
• Introduce malware, interfere with the Service's operation, or probe or scan for vulnerabilities without our permission.
• Use the Service to harass, defraud, or harm others, or to process calls or emails from individuals who have not consented to recording or forwarding under applicable law.

You are responsible for obtaining any consents required from callers and email senders under your local recording and privacy laws.

4. AI-generated extractions; human review

Requestify uses large language models to classify and extract fields from calls and emails. AI extractions are best-effort and not guaranteed to be accurate. You are responsible for reviewing requests created by Requestify before acting on them, and for verifying client names, addresses, phone numbers, and job details against the original transcript or email. We provide a test-mode option that creates parsed records on your dashboard for human review without auto-creating Jobber requests; we recommend using test mode while you build confidence in extraction quality.

We make no warranty that AI extractions will be free of errors, omissions, or hallucinations.

5. Your data; our service

You retain all rights to the data you connect through Jobber, Quo, and forwarded email (together, "Your Data"). You grant us a limited licence to access, store, and process Your Data solely to operate the Service for you. We do not use Your Data to train AI models.

We retain all rights in the Service itself, including its software, design, brand, and documentation. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service under these Terms.

6. Fees

Fees for the Service are set forth on our website or within the Jobber Marketplace. Paid plans are billed via a third-party processor. All fees are non-refundable unless required by law. We will notify you before any changes to our fee structure apply to your account.

7. Third-party services

Requestify depends on third-party services, including Jobber, Anthropic, Google Maps Platform, Quo, Resend, and Railway. Your use of those services is governed by their own terms. We are not responsible for third-party outages, pricing changes, API changes, or disputes between you and those providers.

8. Warranty disclaimer

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or that data will be preserved without loss.

We do not guarantee any specific uptime or availability. We may occasionally perform scheduled or emergency maintenance resulting in temporary Service interruptions. We are not liable for any losses resulting from such downtime.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Elm Studios AI Inc. be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility.

Our total aggregate liability for all claims arising out of or relating to the Service is limited to the greater of (a) the fees you paid to us in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).

While we use industry-standard security, we do not warrant that the Service is immune to cyberattacks or data breaches. Our total aggregate liability for all claims — including those related to unauthorized access to Your Data — is limited to the cap set forth in this Section.

10. Indemnification

You agree to indemnify and hold Elm Studios AI Inc. harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service in breach of these Terms or in violation of law or any third-party right.

11. Termination

You may stop using the Service at any time by disconnecting from the in-app settings screen or from Jobber's Manage Apps page. We may suspend or terminate your access if you violate these Terms, if required by law, or if we retire the Service. On termination, we will delete your account data as described in the Privacy Policy.

12. Governing law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-laws principles. Any dispute relating to these Terms or the Service will be brought exclusively in the courts located in Edmonton, Alberta, and you consent to their jurisdiction.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the app or by email to the account owner. Continued use after an update means you accept the updated Terms.
